Australia - A MAN accused of the torture and murder of a teenager has been denied bail because of concerns he may have connections with motorcycle gangs who could help to interfere with witnesses.
Shaun Jarrod Benporath, 25, is charged with the murder of Raymond Allen, 16, of Mooroopna, in central Victoria.
Police allege Mr Benporath, of Mooroopna, and his co-accused Jamie Leslie Sumner, of Keilor East, abducted and killed the teenager, who disappeared after leaving his Mooroopna home on April 25, 2005.
The teenager's body has never been found.
Police allege Mr Sumner's younger brother claimed his friend Raymond Allen drugged and raped him during a sleep-over in late 2004 or early 2005.
Police allege when Mr Sumner learned of his brother's claims, he and Mr Benporath travelled from Melbourne and contacted the teenager under the guise of giving him marijuana.
Police claim the teenager was abducted and questioned about the alleged sexual assault before being tortured, stabbed and his throat cut.
The missing teenager's DNA has been matched to small droplets of blood found in Mr Sumner's mother's car, police allege.
Mr Benporath's lawyers had argued that he should be granted bail because of exceptional circumstances, including the lengthy delay of his trial, which is not due to start until March 2008.
The defence also said that Mr Benporath had a limited number of prior convictions and they were mainly for driving offences.
But the crown said it had a strong case against Mr Benporath, because he had previously failed to answer bail, had breached two community-based orders and was a risk to the community. The court heard that Sumner's father had agreed to provide surety for Mr Benporath's bail.
But the court was told that the crown believed that would place Mr Benporath in Sumner's debt.
Victorian Supreme Court judge, Elizabeth Curtain, told the court the crown believed Sumner had "a network through motorcycle gangs" who may be used to interfere with witnesses.
Opposing bail, Justice Curtain said:"I am satisfied there is an unacceptable risk the applicant will interfere with the witnesses if released on bail.
"Therefore bail is opposed."
