Hearing scheduled in bike rally lawsuit

A 15th Circuit Court judge has scheduled a hearing in Horry County courts to hear a motion for a preliminary injunction against the city of Myrtle Beach to stop it from enforcing some of the anti-bike rally ordinances the city approved this fall.

The case was filed by Virginia attorney Tom McGrath on behalf of two Myrtle Beach residents, Carol and William O'Day, who are motorcycle enthusiasts and object to the city's local helmet law, and its regulations on mufflers and noise standards.

The hearing is scheduled for 2 p.m. Dec. 2.

The city passed 15 ordinances or amendments to city code this fall designed to curb the two back-to-back May motorcycle rallies that have drawn about 500,000 people to the city and generated complaints from residents about noise, unsafe driving, publicly lewd acts, littering and more.

There are two other suits filed in federal court on behalf of business owners who have stakes in the bike rallies' success, including one that promotes the events and several others that cater to the biker tourists who come to the Grand Strand each May.
